La huelga como un derecho legalmente establecido, aparece en el artículo 123 de la Constitución promulgada el 5 de febrero 1917 en la ciudad Querétaro, en donde se establecen claramente los derechos de asociación, de contratación colectiva, de la suspensión legal del trabajo a través de la huelga con la finalidad de obtener de los patrones mejores condiciones de trabajo como lo es el aumento del salario y con ello buscar un sano equilibrio de los factores de la producción, es decir, el capital y el trabajo. En la ley se le asigna a los gobiernos el papel de árbitro para resolver los conflictos, antes por medio de la Juntas de Conciliación y Arbitraje y ahora a través de los Juzgados o Tribunales del Trabajo.
Antes de 1917 hubo huelgas, pero no estaban legalmente reglamentadas en las leyes del trabajo, incluso en algunos códigos penales la suspensión del trabajo estaba tipificado como delito que se castigaba con cárcel.
Una de las primeras huelgas en nuestro país se realizó en la Catedral Metropolitana de la Ciudad de México el 4 de julio de 1582 como una forma de defensa de los músicos que trabajaban en la catedral, ante la disminución de su salario por pate de las autoridades eclesiásticas, los trabajadores se pusieron de acuerdo para dejar de trabajar y con dicha acción consiguieron que las autoridades eclesiásticas les respetaran sus salarios.
En el periodo del porfiriato, de 1881 a 1911, a pesar de estar prohibidas todo tipo de huelgas, se realizaron 250 huelgas, algunas de ellas muy notables como la de los mineros en Cananea, Sonora, en 1906; y la de los obreros textiles de Río Blanco en Orizaba, Veracruz, el 7 de enero de 1907, en donde hubo represión en contra de los obreros, más de 400 encarcelados y 200 asesinados por el ejército. Con esta ferocidad defendía el gobierno porfirista a los patrones en contra de los trabajadores y por eso estas luchas de protesta fueron precursoras de la Revolución Mexicana de 1910.
En los últimos sexenios de los gobiernos mexicanos que se consideran neoliberales se realizaron pocas huelgas. Según datos de la Junta Federal de Conciliación y Arbitraje y de la Secretaria del Trabajo y Previsión Social, con Ernesto Zedillo hubo 283, con Vicente Fox 267, y en el de Peña Nieto 22. Esta disminución en el número de huelgas refleja, por un lado, la existencia de un fuerte control por parte del sindicalismo oficial patrocinado por el sector empresarial y los gobiernos que los representan y, por otro lado, la presencia de un mercado laboral débil en donde es mayor la oferta de mano de obra por parte de la clase trabajadora que la demanda requerida por las empresas, quedando en desventaja la clase obrera en su lucha por conseguir aumentos en los salarios que compensen el acelerado aumento de la inflación, del precio de los productos de la canasta básica y sin poder recuperar el poder adquisitivo del salario.
La reforma laboral del 2019 fue promovida por la iniciativa del gobierno mexicano y por la influencia del Gobierno de Estados Unidos a causa de la competencia desleal que provocan los bajos salarios pagados a los obreros en nuestro país. Es un hecho que la reforma laboral no se originó por la lucha de los trabajadores de México. A decir de sus artífices (Calderón en 2012, Peña en 2017 y López Obrador en 2019), esta reforma promueve la democracia y la libertad sindical con la finalidad de que los trabajadores tengan mejores condiciones para defender sus intereses fundamentales como lo es tener mejores salarios; esta reforma plantea combatir el sindicalismo oficial y patronal estableciendo como requisito legal obligatorio la consulta de los trabajadores mediante del voto personal, libre, directo y secreto para aprobar las principales decisiones relativas a la representación sindical y el contenido de los contratos colectivos de trabajo, por ejemplo, solicitar el registro de la constitución de sindicatos, cambios de mesas directivas, constancias de representatividad, revisiones salariales y contractuales, titularidad de los contratos colectivos de trabajo, entre otras.
Al inicio del sexenio del presidente Andrés Manuel López Obrador, hubo muy pocas huelgas estalladas y en la segunda parte de su administración, se presentaron algunas como la de Notimex que duró más de tres años; en Audi de Puebla, iniciada el 24 de enero y con una duración de 25 días una vez que se llegó al convenio de aumentar los salarios en un 10.2 por ciento, esta huelga involucró a 3 mil 348 obreros. Otra huelga es la del Nacional Monte de Piedad que involucra a 2 mil 500 trabajadores de 300 sucursales, iniciada el día 15 de febrero del año en curso y todavía continua, la huelga fue originada por que la empresa niega el aumento al salario solicitado por el sindicato por un monto del 5 por ciento y la reinstalación de 20 representantes del sindicato despedidos por la empresa por haber promovida la legitimación del Contrato Colectivo de Trabajo.
Este reducido número de huelgas evidencia que la libertad y democracia sindical promovida por la reforma laboral es todavía formal y no es efectiva para que los obreros luchen por aumentar los reducidos salarios y poder salir de la pobreza crónica en la que han vivido por muchos años. En consecuencia, se requiere que la clase trabajadora de México, se una, se organice y luche de mejor forma para hacer realidad y efectiva la libertad y la democracia sindical que plantea actualmente la reforma laboral, así como el mejoramiento de sus condiciones laborales y de vida.
